Terms of Service

The service

ToldFirst helps you capture a family member’s life stories through guided recorded conversations and turn them into keepsakes: a private web Album, a printed book, a documentary-style film, and a family guest book. By creating an account you agree to these terms and our Privacy Policy.

Your content is yours

You own everything you put in and everything we make from it — recordings, transcripts, photos, books, films. You grant us only the license we need to operate the service: to store, process, transcribe, analyze, and render your content into the keepsakes you request, and to deliver it to people you choose to share it with. That license ends when you delete your content, except for lawful backups that age out on a rolling schedule.

We will never use your content to train AI models or clone anyone’s voice.

Your responsibilities

  • Record people only with their permission, and share their stories the way they’d want them shared.
  • Upload only content you have the right to use (your family’s photos: yes; copyrighted music: no).
  • Keep your password safe; you’re responsible for activity on your account.
  • Don’t abuse the service — no unlawful content, no attempts to access other families’ projects, no automated scraping or bulk misuse of AI features.

About the AI

Transcription and AI assistance are imperfect. Transcripts can contain errors; AI-suggested questions, captions, and summaries can be wrong; AI-generated illustrative images are labeled as impressions, not photographs. Review your keepsakes before printing or sharing — we build in checks, but you know your family’s story better than any model.

Payments

Paid plans and keepsakes are one-time purchases unless explicitly stated otherwise, processed by Stripe. Digital purchases can be refunded within 30 days if we haven’t delivered what we promised. Printed books have a defect reprint policy: if your book arrives damaged or misprinted, we’ll replace it. If something’s wrong, email us — a human reads it.

Ending the relationship

You can stop using ToldFirst and delete your account at any time (see the Privacy Policy for how). We may suspend accounts that violate these terms, with notice and a chance to export your content except in cases of clear abuse. If we ever discontinue the service, we’ll give at least 90 days’ notice and a way to export everything.

Disclaimers and limits

The service is provided “as is.” To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.

Housekeeping

These terms are governed by Kansas law. If we change them materially, we’ll email account holders before the change takes effect. If any part is found unenforceable, the rest stands. Questions: hello@toldfirst.com.
